Introduction

These Terms of Use (hereinafter referred to as the “Terms”) constitute a legally binding agreement between you (hereinafter referred to as the “User” or “you”) and self-entrepreneur Olshanska Anastasiia (hereinafter referred to as the “Company”, “we”, “us”, or “our”), governing your access to and use of the mobile application Marketium (hereinafter referred to as the “Application” or the “Service”).

Marketium is an educational and interactive mobile application designed to provide users with a gamified learning experience focused on marketing terminology, strategic thinking, and team-based engagement. The Application is intended to serve professionals, teams, and individuals interested in improving their skills in an interactive format.

By downloading, installing, accessing, or otherwise using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must immediately discontinue use of the Application.

The Company reserves the right to modify, update, or revise these Terms at any time. Continued use of the Application after such changes constitutes your acceptance of the updated Terms.

Nature and Scope of the Service

The Application is provided as a digital product offering interactive gameplay, structured content sets, and learning experiences. The Service may include both free and paid features, including access to additional content through in-app purchases (such as 24-hour temporary access or lifetime set unlocks).

The Company continuously develops and improves the Application and reserves the right to modify, suspend, or discontinue any part of the Service at any time. Such modifications may include changes to gameplay mechanics, content availability, features, or technical functionality.

While we strive to ensure uninterrupted access to the Service, we do not guarantee that the Application will always be available or operate without interruptions, delays, or errors.

Conditions of Use

The Application is intended strictly for personal, non-commercial use. By using the Service, you agree to use it in accordance with applicable laws, regulations, and these Terms.

You undertake to use the Application in good faith and in a manner consistent with its intended purpose.

You agree not to engage in any activity that could damage, disable, overburden, or impair the functioning of the Application or interfere with any other party’s use of the Service.

In particular, you agree not to attempt to exploit vulnerabilities, manipulate gameplay mechanics in unintended ways, or use automated tools such as bots, scripts, or other software designed to interact with the Application without authorization.

The Company reserves the right, at its sole discretion, to restrict or terminate access to the Application if it determines that a user has violated these Terms, engaged in inappropriate or abusive behavior or for legal or technical reasons.

If you provide feedback, suggestions, or ideas related to the Services, you agree that:

User Generated Content

The Application does not include user-generated content features as a core functionality. However, limited user input (such as nicknames or gameplay identifiers) may be used within the Application.

You agree that such content:

• does not violate laws;
• does not infringe third-party rights;
• is not offensive or harmful.

User Status and Eligibility

The Application is designed for a general audience and is not specifically targeted at children under the age of 13. However, due to the nature of the Service, it may be accessed by a wide range of users.

By using the Application, you represent that you have the legal capacity to enter into these Terms or that you are using the Application under the supervision of a parent or legal guardian, where required by applicable law.

By using the Services, you represent and warrant that:

No Account Requirement

The Application has been designed to function without requiring users to create an account or provide personal identifying information. As a result, users may access and use the Service anonymously.

Despite the absence of account-based functionality, certain technical and gameplay-related data may still be processed to ensure the proper functioning of the Application. Such processing is further described in the Privacy Policy.

Intellectual Property Rights

All intellectual property rights in and to the Application, including but not limited to software, content sets, game mechanics, text, design elements, graphics, and branding, are owned by or licensed to the Company.

Certain elements of the Application, including but not limited to images and audio files may be sourced from third-party platforms or content libraries. Such materials are used in accordance with the applicable license terms provided by their respective owners or distributors.

These third-party resources may include, without limitation, content obtained from publicly available libraries or marketplaces such as:

The Company ensures that any such materials are used in compliance with the relevant licensing terms and conditions and only to the extent permitted by such licenses.

All rights not expressly granted to the User under these Terms remain reserved by the Company or the respective rights holders.

The Application and its content are protected by applicable intellectual property laws and international treaties.

The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the Application solely for personal, non-commercial purposes. This license does not permit you to copy, reproduce, distribute, modify, reverse engineer, or otherwise exploit any part of the Application except as expressly allowed.

Any unauthorized use of the Application or its content may result in termination of your right to use the Service and may give rise to legal liability.

In-App Purchases and Digital Content

The Application may offer optional paid features, including individual word or card sets, accessible on a one-time purchase basis.

The available purchase options include:

• 24-Hour Access: Grants temporary access to a selected content set for a period of 24 consecutive hours from the time of purchase.
• Lifetime Access: Grants permanent, unlimited access to a selected content set for as long as the Application is supported and available.

All in-app purchases are one-time, non-recurring transactions processed exclusively through the Apple App Store using Apple’s In-App Purchase system. By making a purchase, you agree to comply with Apple’s applicable terms and conditions.

The Company does not collect, store, or process payment credentials such as credit card details, banking data, or financial credentials. Payment processing, billing, and refunds are handled entirely by Apple.

Because purchases are non-subscription transactions, they do not automatically renew. Refund requests must be directed to Apple and are subject to Apple’s standard refund policies.

Push Notifications

The Application may send push notifications to users. These notifications are only sent after the user has explicitly granted permission through the device operating system.

Push notifications are designed to enhance user engagement and improve the overall experience.

Push notifications may be triggered based on user interaction with the Application, including, for example, inactivity, incomplete gameplay sessions, engagement with specific content, or in-app purchase status updates.

The delivery of push notifications is carried out through third-party infrastructure, including Apple Push Notification Service (APNs) and other supporting services.

Users may disable push notifications at any time through their device settings.

Third-Party Services

The Application may rely on third-party services to support its functionality, including cloud storage providers, in-app purchase and entitlement management tools, and notification delivery systems.

While the Company selects such providers with reasonable care, it does not control their independent operations and is not responsible for their policies or practices.

Such third-party services act as independent service providers and are responsible for their own data processing practices.

Your interaction with any third-party services is governed by the respective terms and policies of those providers.

Disclaimer of Warranties

The Application is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

The Company does not warrant that the Application will meet your expectations, operate without interruption, or be free of errors or defects. The Company makes no representations regarding the accuracy, reliability, or completeness of the content or functionality of the Service.

Limitation of Liability

The Company shall only be liable to the extent permitted by applicable law, any additional liability is excluded. The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of, or inability to use, the Application.

This includes, without limitation, damages for loss of data, loss of profits, business interruption, or any other losses resulting from reliance on the Service.

Termination

These Terms shall remain in effect for as long as you use the Application.

The Company reserves the right to suspend or terminate your access to the Service at any time if it determines that you have violated these Terms or engaged in conduct that may harm the Application, the Company, or other users.

You may terminate your use of the Application at any time by deleting it from your device.

Modifications to the Service and Terms

The Company reserves the right to modify the Application and these Terms at any time. Changes may be made to reflect updates in functionality, legal requirements, or operational practices.

Where appropriate, users may be notified of significant changes through the Application. Continued use of the Service after such changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and interpreted in accordance with the laws of Ukraine.

Electronic Communications

By using the Application, you consent to receive communications electronically, including notifications, updates, and other information related to the Service.

Such communications satisfy any legal requirement that communications be made in writing.
